FYBERCOM NETWORK MANAGEMENT POLICY
FyberCom LLC (“FyberCom” or the “Company”) provides this Network Management Policy (“Policy”) in accordance with the Federal Communications Commission's Transparency Rule found at 47 C.F.R. § 8.1(a) to ensure customers have sufficient information to make informed decisions about the purchase of broadband internet access services.
I. NETWORK MANAGEMENT PRACTICES
FyberCom does not discriminate against lawful internet content, applications, services, or non-harmful devices. The bullets below provide an overview of FyberCom's network practices with respect to its fiber-optic and fixed wireless broadband internet access services.
- Blocking. FyberCom does not block or otherwise prevent end user access to lawful content, applications, or services. FyberCom does engage in the reasonable network management practices described below.
- Throttling. FyberCom does not degrade or impair access to lawful internet traffic on the basis of content, application, service, user, or use of a non-harmful device. FyberCom does engage in the reasonable network management practices described below.
- Affiliated Prioritization. FyberCom does not directly or indirectly favor some traffic over other traffic, including through use of techniques such as traffic shaping, prioritization, or resource reservation, to benefit an affiliate.
- Paid Prioritization. FyberCom does not directly or indirectly favor some traffic over other traffic, including through use of techniques such as traffic shaping, prioritization, or resource reservation, in exchange for consideration, monetary or otherwise.
- Network Management. FyberCom manages its network with the goal of delivering the best possible internet access service to all of its customers. To further this effort, FyberCom uses reasonable network management practices that are consistent with industry standards. FyberCom currently does not maintain a separate system to manage times of internet congestion. As network technologies and customer usage of FyberCom's networks continue to evolve, FyberCom reserves the right to implement a congestion management system if deemed necessary in the performance of reasonable network management and in order to maintain a good broadband internet access experience for our customers. FyberCom will update this Policy if a congestion management system is implemented.
- Application-Specific Behavior. FyberCom does not block or rate-control specific protocols or protocol ports, does not modify protocol fields in ways not prescribed by protocol standards, and does not otherwise inhibit or favor certain applications or classes of applications.
- Device Attachment Rules. FyberCom may recommend and/or provide devices such as wireless modems, routers, or other gateway devices to be used in connection with its services to provide the best customer experience. Notwithstanding the foregoing, customers may use devices of their choice to connect to FyberCom's internet access service.
- Security. FyberCom employs security procedures to protect its network and its customer records from unauthorized access by third parties that are consistent with industry standards. FyberCom does not guarantee that it can protect customers from any and/or all security breaches. FyberCom may, but undertakes no obligation to, monitor or protect customer traffic from spam, viruses, denial-of-service attacks, or other malicious, unlawful, or unwanted activities. Customers can purchase spam filtering and/or anti-virus software or services from commercial vendors to meet their needs, so long as such software or services do not disrupt or degrade the traffic of other FyberCom customers or harm the network.
II. PERFORMANCE CHARACTERISTICS
1. Service Description
FyberCom offers broadband internet access over fiber-optic technology with upload/download speeds up to 1/1 Gbps and internet access over fixed wireless access technology with upload/download speeds up to 10/10 Gbps. These speeds are suitable for real-time applications such as gaming and streaming content. While FyberCom strives to provide optimal performance, specific performance levels are not guaranteed and can be affected by several factors, including the number of devices connected at a customer's location and network conditions. Actual speeds may also be impacted by the length, capacity, and congestion of data transport facilities between FyberCom's service area and internet nodes.
2. Latency
Latency, which is the time delay in transmitting or receiving packets on a network, is another measurement of internet performance. Latency is primarily a function of the distance between two points of transmission but also can be affected by the number and quality of the network or networks used in transmission. Latency is typically measured in milliseconds, and generally has no significant impact on typical everyday Internet usage. As latency varies based on a number of factors, most importantly the distance between a customer's computer and the ultimate internet destination, it is not possible to provide customers with a single figure that defines latency as part of a customer's experience.
